Will writing activities should become subject to regulation, the Legal Services Board (LSB) said today. Following a two-year investigation, the LSB has written to the Lord Chancellor to recommend that the list of reserved legal activities be amended to include advice upon and preparation and drafting of a will or codicil.

Forty applications for Alternative Business Structure (ABS) licenses reached the formal decision phase in the Solicitors Regulation Authority's (SRA) approval process between April and September this year, according to statistics. The authority received 198 ABS applications between January and September, and the number of ABS licenses granted reaches 39, up by 6 from the end of September.

The Legal Services Board (LSB) has started a final consultation, proposing that Will writing and estate administration, along with extraction of the Grant of Probate, should be added to the list of reserved activities in the legal sector in England and Wales. The consultation, which is running for six weeks until 8 November 2012, highlights three major conclusions.
